A compensation claim rarely turns on one document. What matters is a traceable sequence from the event through the first record of the damage to treatment, repair and financial consequences.

01 Record the event and the people involved
Start with the basic facts. A short, factual chronology makes the later assessment easier.
02 Secure the report and the evidence
Evidence should show the sequence and the condition immediately after the event as accurately as possible.
03 Document the health consequences
In personal injury cases, the course matters. Keep first reports and later records together, in chronological order.
04 Substantiate the financial effects
Link each financial disadvantage to a period and a supporting record.
05 Insurance correspondence and submission
Keep not only the response but also the request and the documents that were submitted with it.
Why an organised file matters
Compensation claims depend on a specific loss, its cause and the resulting disadvantages. Section 1295 of the Austrian Civil Code provides the general basis for compensation for loss caused unlawfully and culpably. In personal injury cases, section 1325 ABGB refers among other things to treatment costs, loss of earnings and compensation for pain and suffering as possible heads of loss.
The documents do not automatically prove every element of a claim. They show what happened, which consequences followed and where further information is still needed. A continuous chronology is particularly useful when symptoms or costs continue over time.
Keep files in their original form wherever possible. Your own summaries may be added, but they should not replace medical reports, invoices or official records.
