What are the basic requirements of an Austrian damages claim? +
Damage, causation, wrongfulness and fault usually have to be assessed. Depending on the legal basis, strict liability, contract, protective statutes or special burden-of-proof rules may also apply.
Which documents should I preserve first? +
Preserve photographs, medical records, invoices, contracts, messages, witness details and a chronology. Do not alter or repair the condition too quickly if that could destroy important evidence.
How is the amount of loss determined? +
Each head of loss is recorded separately with its basis, period, amount and evidence. Personal injury may include treatment costs, lost earnings, care and pain compensation; property loss may include repair, current or replacement value and consequential costs.
What is contributory negligence? +
If the injured person contributed to the occurrence or increase of the loss, compensation may be reduced proportionately. The percentage depends on each side’s concrete contribution.
When does a damages claim become time-barred? +
The short limitation period is often three years from knowledge of the damage and the person responsible. Its start, interruption and longer periods may require a different assessment in the individual case.
Does every damages case have to go to court? +
No. Many cases begin with a documented demand and negotiations with the other party or insurer. Court action becomes relevant where liability, amount or limitation cannot otherwise be resolved reliably.
