Damage
A disadvantage affecting property, rights or protected interests that must be compensated where the statutory requirements are met.
In brief
Damage may be pecuniary or non-pecuniary. The first questions are which protected interest was affected and what caused the disadvantage.
The amount is not determined by the event alone, but by comparing the actual position with the position that would have existed without the harmful event.
