Entitlement to claim
The right to pursue a specific damages claim in one’s own name.
In brief
The person whose protected right was infringed and whose loss was caused is generally entitled to claim. Special rules may apply to relatives or successors.
It must therefore be clarified who owns the claim and whether it was assigned, inherited or otherwise transferred.
