For damages claims, the relevant issue is often when you knew about the loss and the person responsible for compensation. Section 1489 ABGB generally provides three years from that knowledge. The exact start, suspension or other effect of procedural steps depends on the circumstances and the claim.

Legal framework

  • Section 1489 ABGB generally provides a three-year period for damages claims from knowledge of the loss and the person responsible; special statutory rules may differ.
  • Section 1478 ABGB contains the general long limitation rule where no special period applies.
  • Sections 1494 and 1496 ABGB concern special situations affecting the running of periods. Whether they apply depends on the personal and factual circumstances.

Does the period always start on the day of the accident or loss?

Not necessarily. For a claim under section 1489 ABGB, the relevant point is generally knowledge of the loss and the person responsible. The event date and the knowledge date may therefore differ.

Is a report to the insurer enough?

A report may be important for the chronology. Whether it affects limitation or sufficiently asserts the claim depends on its content, recipient and the circumstances.

Can the check state the exact end date?

No. The claim type, dates of knowledge, possible special rules and previous steps must first be assessed using the original documents.
